NOTICE: Please read these user conditions carefully. They set out the terms under which this website (i.e., the website operated by Countryside Properties PLC together with the content and any search facilities, directory services, downloads, links and other internet services provided by Countryside Properties PLC from time to time) is made available to you. By accessing the website you agree to be bound by these conditions.
Our Obligations to You
- We agree to use our reasonable endeavours to maintain the website in a fully operating condition and error free. As we cannot guarantee that the website will always be fully operational or error free we do not accept responsibility for any defects that may exist, or for any costs, loss of profits, loss of data, or consequential losses arising from your use of, or inability to access the website.
- The website is provided without any warranties or guarantees unless specifically stated.
- We reserve the right to suspend, restrict, or terminate access to the website for any reason at any time.
- Whilst we take reasonable precautions to ensure that any downloads we make available will be virus free we do not warrant that any downloads will be virus free and will not cause interruptions with your computer systems.
- Whilst we make every reasonable effort to create links to other high quality, reputable websites, as they are not under the control of Countryside Properties PLC, we cannot accept responsibility for their use of your data, their site content or their services offered to you. Neither can we be deemed to have endorsed their content.
Your Obligation to Us
- You agree that you will only use the website in a manner that is consistent with these user conditions and in such a way as to ensure compliance with all applicable laws and regulations. In particular, you will not use the website to transmit or post any material which is defamatory, offensive, or of an obscene or menacing character, or which may, in our judgement, cause annoyance, inconvenience or anxiety to any person.
- To the extent to which your use, or the use by any person who may be authorised by you or for whom you are responsible (for example as the parent or guardian of a child) causes loss or damage to any person, you agree to indemnify Countryside Properties PLC immediately on demand in relation to any such losses or damages attributable to Countryside Properties PLC, including where necessary any legal and administrative, or technical charges that may arise from such use.
- You are responsible for obtaining the equipment and paying all telephone charges necessary to access and use the website. You are also responsible for making your own back-up arrangements.
- You agree that the material and content contained within or provided by the website is for your personal use only and may not be used for commercial purposes or distributed commercially without our permission. Your use of the website carries with it no rights in relation to copyright, trade marks or other intellectual property rights of Countryside Properties PLC.
- You agree not to use the website or the services made available to you on or via the website such that you cause the whole or part of the website or such services to be interrupted, damaged, rendered less efficient or in any way impaired.
- Any personal details provided by you to us are important and must be true, correct and complete. You agree to notify us immediately of any changes which are relevant to your registration.
- You signify your consent to us collecting and using your personal information by your use of this website. As per Countryside Properties PLC privacy policy, we use the personal information that we collect from you to identify personal preferences and match your needs with relevant services. Your data may be used by us, and our associated companies, to inform you about changes to our website, new services and offers that you might find interesting. Terms and Conditions for Countryside Properties (Northern) Limited’s
Apple iPhone Prize draw
The Prize Draw is open to all adults resident in the United Kingdom, Ireland, the Channel Isles and the Isle of Man, except for employees and family members of employees of Countryside Properties (Northern) Limited and Countryside Properties plc or any of its subsidiaries (“Countryside Properties”).
In order to be eligible for a prize draw, the participants shall complete an on-line Countryside “Brand” Market research survey between 16 January 2008 and 30 November 2008 (connection date and time in the UK being proof thereof) and shall identify themselves by surname, first name, address and e-mail address. The e-mail address given will be used by Countryside Properties for confirmation of the postal address of the winner. Entries with incomplete or incorrect contact details will not be entered into the draw.
Only one entry per household (same surname and postal address) is permitted for the entire period of the Prize Draw. The prize will be one Apple iPhone (excluding insurance, connection and tariffs) per draw. A total of 2 Apple iPhones will be awarded during the promotion. Countryside will order the Apple iPhones through its preferred supplier. Both winning participants shall be responsible for paying the connection and tariff fees required to operate the Apple iPhones.
Countryside Properties will hold the first prize draw on the 1st June 2008 and the second prize draw on 1st December 2008 by randomly selecting a winner on each date from the names of all eligible participants.
The winners will be contacted by e-mail in order to confirm their postal address. The contact details provided at the moment of registration will be used to send the prize. If the postal address is not valid or if the participant does not reply within 15 days following receipt of the e-mail, he/she will lose his/her prize. Countryside will use reasonable endeavours to send the prizes within 6 weeks after the relevant prize draw. If a prize is returned by Royal Mail marked “gone away” or “undeliverable” or “does not live at the address given” the winner will be deemed to have rejected it and the prize shall revert to Countryside’s ownership. The winner shall no longer be able to claim it..
Countryside Properties will not be held responsible for damage, theft or loss during shipping. No purchase is necessary to enter the prize draw.
A cash alternative may be made available but this decision shall be made at the absolute discretion of Countryside Properties. The amount will be determined by Countryside Properties and, if available, it may be less than the manufacturer’s UK RRP. In force majeure cases or if circumstances require it, Countryside Properties reserve the right to replace the aforementioned prizes with similar prizes of an approximate equivalent value.
The address for delivery of the Apple iPhone must be within the UK, Republic of Ireland, Isle of Man or Channel Islands. The Apple iPhone will be insured during its carriage and the addressee will be required to sign for its receipt.
Countryside Properties’ decision on eligibility of any participant shall be final and no correspondence or discussion will be entered into. Participants authorise Countryside Properties to carry out checks on their identity and contact details if necessary. All false declarations will lead to the immediate elimination of a participant from the prize draw.
Any personal data supplied in completion of the survey will be used for future marketing, sales or research purposes by the relevant departments of Countryside Properties or their marketing or research agencies, unless the participant has requested that his or her personal data shall not be so used. Apart from such aforementioned use personal data will not be disclosed to a third party without the individual’s prior consent.
Participants, or their parents/ legal guardians if a participant is not yet of age, may exercise the right to access, modify, rectify and delete information concerning them by writing to the Data Controller (Gary Shillinglaw – Company Secretary) Countryside Properties PLC, Countryside House, The Drive, Brentwood, Essex CM13 3AT United Kingdom.
The winning participants agree that, if they receive an Apple iPhone, Countryside Properties has the right, without additional payment or permission, to use their names and town of residence for related promotional purposes.
Except for liability for death or personal injury caused by the negligence of Countryside Properties, Countryside Properties shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential loss by reason of any act or omission by Countryside Properties, its servants or agents, in connection with any matter arising from the availability, delivery period, supply, handover, delivery or subsequent performance of the Apple iPhone.
Countryside Properties reserves the right to amend or withdraw any part of this offer due to circumstances beyond its control.
Participation in the Prize Draw implies the acknowledgement and acceptance of the characteristics and limits of the internet, the absence of protection for certain data against possible hijacking or piracy and the risks of contamination by any viruses operating on the network. Countryside Properties refuses responsibility for misuse or incidents related to the use of a computer by the participant, his/her internet access, the maintenance or malfunction of the website, his/her telephone line or any other technical connection and sending forms to an incomplete or incorrect address.
Countryside Properties will not be held responsible for any possible malfunctions of the internet network leading the faults in the administration, the security, integrity or the management of the prize draw. The connection of any person to the site and their participation in the Prize Draw remains the participants’ responsibility. All participants must take the appropriate measures to protect their own data and/or software stored in their IT equipment against any external threats/attacks/viruses.
Participation in this survey and prize draw implies the acceptance without reserve of these terms and conditions in full. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.
